Hideout settles five-year lawsuit with Mustang, agrees to pay $250,000 in legal fees

The Town of Hideout and Mustang Development LLC have settled another lawsuit that had been pending since 2021, marking the second settlement between the parties since Mayor Ralph Severini was elected in November 2026.

As we reported in October 2025, Judge Jennifer Mabey of the 4th District Court in Heber City ruled in favor of Mustang on key issues involving the interpretation of the maximum number of units the developer is entitled to under its Master Development Agreement with Hideout.

When the parties announced the settlement, there was still a pending court motion by Mustang seeking recovery of $325,000 in attorney fees from Hideout.

In a statement, Mustang said the total legal fees incurred in the case exceeded $350,000 and continued to grow. “However, based on Mustang’s continued commitment to the community, it has agreed to reduce the amount to $250,000.”

Mustang said there are still two pending lawsuits with Hideout and that the parties have agreed to attempt mediation to resolve damages.

“Mustang Development has been willing to work with the new administration to resolve these litigation matters, which have limited the ability to invest in additional amenities and improvements in Hideout due to actions by the previous administration,” the company said.
